As the presentations at EITC '96 make clear, the development of electronic commerce depends upon the interplay of technological, financial, regulatory and legal factors. In particular, businesses and consumers are looking for a clear legal framework to clarify such issues as: the legal validity of electronic transactions, allowable evidence in case of litigation, identification and authentication, protecting personal data, compliance with tax and customs regulations, and protecting intellectual property.
Suppose someone in the UK browses the electronic catalogue of an Italian company and finds the exact products they need. They place an important order, for which payment will be made electronically. The Italian company relies on a German firm to fulfil part of the ordering process. However, something goes wrong in the business chain, and a claim for compensation is brought to court...
Come to this dramatised reconstruction of an electronic commerce-related court case to gain a better appreciation of the legal issues likely to arise when trading in cyberspace.
