Working group on Advanced Legal Issues in Virtual Enterprise

The ALIVE working group is framed within IST 2000.VIII.1.2 support activities and is devoted to legal aspects of the "Smart" organisations addressed in key area 2.2.2. ALIVE is intended to foster cooperation among industry and legal and ICT professionals, with the aim to identify and classify the legal issues arising form the emergence of the Virtual Enterprise, to exchange information on ongoing relevant research and exploit co-operation opportunities on common themes and to compare emerging issues and the existing legal and regulatory frameworks in view to generating suggestions for future policy development and new RTD actions. ALIVE will assess the status of legal issues investigation also in the USA, the non-European Country most advanced on the subject. Specific performance criteria will be used to evaluate conformance to objectives, related to Community impact and Promotional impact. The WG operation will last 24 months and will involve members from most EU member countries.

Objectives:
The Virtual Enterprise (VE) is a co-operative alliance between entities with distinct legal identities, which come together to exploit a particular business opportunity. Through working group technologies, the VE provides participants with a framework whereby they can share the risks and returns involved in bringing new products and services to market. ALIVE is intended to define roadmaps for the resolution of legal issues associated with the VE paradigm, by identifying and classifying the arising legal issues, exchanging information on ongoing research and exploiting cooperation opportunities on common themes, and comparing emerging legal issues and the existing legal and regulatory frameworks in view to generating suggestions for future policy development and new RTD actions. Given the global nature of the Virtual Enterprise, ALIVE will assess the status of legal issues investigation also in the United States, and will promote the establishment of a specific Interest Group.

Work description:
Activities are structured to achieve expected results through the creation and exploitation of a conceptual and support infrastructure:
- a taxonomy of legal issues, based on the reference life-cycle process of a Virtual Enterprise, to constitute a common dictionary to guide in the discussions and in the distillation of findings and existing knowledge;
- a co-operation and dissemination support environment to foster exchange of ideas and results from parallel running RTD initiatives, constituted of a dedicated web site and a newsletter publishing mechanism.
Further mechanisms to achieve working group objectives will be the organisation and conduction of dedicated workshops and of a conclusive international conference. The creation of roadmaps will be performed through the operation of dedicated subgroups devoted to the conduction of specific studies and surveys on issues that cannot be fully addressed through the interaction of members. Consensus building on the roadmaps will be pursued through the involvement into the discussion of policy makers and RTD action initiators. Agreed roadmaps will consist of dedicated reports addressing the description of the issues, the status of resolution and the recommended actions. A specific effort will be devoted to continuously increase the dimension of the co-operative group, through the search of new working group members, particularly within new European RTD projects.

The activities are structured into four work packages:
1. Co-operation and dissemination infrastructure: reference taxonomy generation, web-based co-operation environment establishment and operation, newsletter issuing and distribution;
2. Strategy development: specific studies and surveys, construction of roadmaps and building of consensus on proposed issue resolution actions;
3. Events: three workshops and a conclusive international conference4 Management.

Results from the working group will be measured and evaluated against specific performance criteria.
