The Nice Treaty introduces into the EC Treaty a legal basis for the establishment of a Community patent jurisdiction. This allows the Court of Justice to be given jurisdiction in disputes relating to the application of acts which create Community industrial property rights, and allows for the establishment of judicial panels to hear certain types of proceedings.

This working document contains in its annex detailed suggestions on the jurisdictional arrangements based on Commission�s thinking so far, pending a formal proposal by the Commission. The primary purpose of this working document at this stage is to facilitate discussions in the Council with a view to reaching an overall political agreement on the main elements of the Community patent system. The Commission reserves the right to modify or complement the suggestions made in this working document should this appear to be appropriate at the time when it may be in a position to make a formal legislative proposal which will then be subject to scrutiny in accordance with the usual legislative procedures.
