Abstract

The object of this report is to make a new inventory of patents taken out within the E.E.C. concerning micro-organisms and to analyse their contents so as to pin-point the technological and industrial positions of the different countries. It is however necessary to set out beforehand the limits of such an undertaking for, by reason of the living nature of the "object" to be patented, legal problems arise as to the patentability of the micro-organisms as well as to the terms and conditions of use. These problems which will be dealt with in detail in the course of the study, are at the root of the reservations that must be made when dealing with the study of patents taken out in the area of biotechnology. Indeed it is important to point out that the patent in this area must be considered as an indication rather than an indicator of the economic and technological positions of firms and countries. First of all the report will give a succinct introduction to the micro-organisms as well as the advantages they offer over previous processes before going on to analyse in the second part the industrial circumstances of the different firms and countries. The third part will tackle the heart of the matter by establishing the current position on technological control by patents of the countries of the E.E.C. and its principal competitors, the USA and Japan. Finally, these different thoughts will lead into a final part on certain conclusions of the E.E.C. and some recommendations so that these countries may stand up to American and Japanese competition.
