LEGAL ASPECTS OF EDIFunded under: IS-TEDIS 1
This paper looks at the different legal aspects of EDI from the point of view of activities carried out under the TEDIS Community programme, the general direction of the programme and the work done. The latter includes an analysis of the judicial situation of member states regarding the electronic transfer of commercial information, which picks out three types of constraints and offers recommendations as regards obligations or requirements concerning written material and signatures. Coordination is essential; it is imperative to have dialogue between sectors, both at the European and international level. A number of difficulties connected with legal requirements have been revealed and are being considered at Community and national level. These studies should lead to a gradual change in the law, giving a more clearly defined place to new technologies and their use, in a forward-looking, not purely legal, way. A concrete, practical approach prevails, making it possible to anticipate the necessary legal changes to which the attention of legislators should be drawn.
