Abstract

Rather than stigmatising businesses that have failed, the EU needs to encourage a positive attitude to risk-taking and failure, so as to promote the entrepreneurial spirit that Europe needs. In order to share good practices in this area and to initiate a dialogue among experts and policy-makers, the Commission organised, together with the Dutch Ministry of Economic Affairs, a seminar on business failure, which took place in Spring 2001 in Noordwijk (NL). This brochure presents the conclusions of the seminar, sets out principles and guidelines for effective insolvency systems, and describes examples of good practice in restructuring, bankruptcy and a fresh start.
