Patenting DNA sequences (polynucleotides) and scope of protection in the European Union: An evaluation



The aim of this background study is to give an overview of the various issues involved in the patentability of DNA sequences and the scope of protection of such patents. If it does not deal with ethical issues, which were excluded from treatment in this study, as they require a different approach, which was outside the scope of the mission of the author and the Expert Group on Biotechnological inventions. This study is more a discussion paper than a report containing fixed rules and viewpoints. It has been the basis for discussion in an Expert Group on Biotechnological Inventions and the 16(c) Report which the Commission is committed to produce yearly evaluating the functioning of Dir. 98/44/EC and its contents in the Member States.
