A Council Decision of 15.2.1993 concerning the conclusion of the Protocol to the Convention of 8 October 1990 between the Governments of the Federal Republics of Germany and of the Czech and Slovak Federal Republics and the European Economic Community on the International Commission for the Protection of the Elbe (93/114/EEC) considers that it is inter alia essential that the International Commission established under the Convention (Decision 91/598/EEC, published in OJ No L 321 of 23.11.1991) be given legal capacity and personality in order to carry out its tasks. To this end, the signatory Parties have agreed that the International Commission shall have legal capacity in accordance with the law obtaining at the place at which its Secretariat has its headquarters. It shall in particular have the capacity to conclude any contracts required to fulfil its tasks, to acquire and dispose of moveable property and to take part in legal proceedings. The Protocol shall enter into force 30 days after all signatories have informed the Government of Germany that any preconditions for the entry into force required by national laws have been fulfilled.
