Telecoms and Media Regulation 2007

A one day workshop will survey and assess in an informal and interactive manner, with a restricted number of interested actors, the evidence, alternatives and possible trade-offs concerning the most critical elements of an evolving future Electronic Communications regulatory framework, on 27 April in Brussels.

The current Electronic Communications regulatory framework has now been in place for almost three years, and in July this year the European Commission will carry out a review to look at what has worked well within the current framework and what needs to be changed in order to take evolutions of technological and of economic nature on the electronic communications market. This event will look to pre-empt this review and examine the most crucial issues surrounding the review, and moving forward to a modern, market-oriented regulatory framework which delivers optimal benefits to consumers and industry alike.

Led and moderated by 3 of the top experts in this area, and including comments and contribution from regulatory bodies representing EU member states, the day will be split into 3 distinct sections.

The first session will look at competitive scenarios, and in particular the status of Access vs Network based competition. It will look at whether the present regulatory framework provides adequate incentives to genuine network based competition and examine the Dynamic Ladder of Investments approach. We will be looking at lessons from the experiences of different EU Member States, and discuss how to deal with local institutions and contingencies in setting up a competition development strategy.

The second session will move on to look at “Emerging” technologies, and in particular their status in competition policy and the rationale for regulation or non-regulation. Analyses will be provided of EU case studies, looking at VoIP, FTTH, xDSL and converging services amongst others, and the session will also examine decision criteria in defining and coping with emerging technologies.

The final session will look specifically at relevant markets, focusing on the range of overall assessments of the present guidelines, and look at whether or not it is appropriate to remove regulation from retail markets. It will finish with a look at clustering possibilities and how to account for convergence phenomena.

General concerns will be addressed as well:

• The administration of legal evidence in a dynamic and future looking environment.
• How to share the burden of regulation and what should be the appropriate incentives to comply.
• Regulation strategy choices within a dynamic industry process.
