The European Commission has published a proposal for a European Parliament and Council Directive amending Directive 89/552/EEC on the coordination of national provisions concerning the pursuit of television broadcasting activities (OJ No L 298 of 17.10.1995). Directive 89/552/EEC constitutes the regulatory framework for broadcasting in the internal market. The present proposal amends this Directive in the light of the European Commission's report on the first five years of its operation and recent developments in the field of television broadcasting. In particular, it addresses the need to clarify the concept of jurisdiction as applied specifically to the audiovisual sector. Broadcasters under the jurisdiction of a Member State are defined as being those established within the territory of that Member State, in which they must have a fixed establishment and actually pursue an economic activity. The conditions under which Member States may restrict or suspend transmissions from other Member States are also determined. The proposed Directive extends measures for the promotion of European works for a further ten years with a view to improving the competitivity of the European programme industry. It also introduces a distinction between "television advertising" and "teleshopping" and provides for restrictions in both areas.
