The patenting of human DNA: Global trends in commercial and public sector activity

Objective

Intellectual property (IP) protection is widely recognised as a crucially important component of public policy to promote innovation in the development of the life sciences and biotechnology. The overall aim of this project is to provide an evidence -based analysis of the dynamics of patent applications and grants claiming human DNA sequences. A partnership with Glaxo SmithKline Plc will enable us to identify and classify a comprehensive set of patents for the period 1981-2003. This unique dataset will provide systematic evidence on the extent to which companies, universities, and research institutes seek to protect their DNA-based inventions by means of patents. The data will also be used to conduct a systematic analysis of the rate of patent grants at the EPO. Information will also be gathered from patent assignees to analyse the fate of patents that were not granted and the ways in which granted DNA patents are being exploited. The data will be interpreted in the light of current national and EU policy frameworks for intellectual property rights in biotechnology.
