Unfairness in contracts and its effect in European contract law and international trade contracts

Objective

The project is a PhD research in the field of European Contract Law, aimed at determining the effect of unfairness in commercial contracts within the European Union, inter alia in light of EU Directive 93/13/EEC on Unfair Terms in Consumer Contracts. A comparison will be made to the rules regarding unfairness in regard to specific types of International Trade Contracts and the effect of unfairness in Private International Law. A Commission on European Contract Law is in the process of making an European Code of Contracts which is intended to harmonize the contract law within the EU and make business transactions within the Single European Market easier. Unfairness has been an invalidation reason in most of the EU countries in the past, and it is essential for the future use of the Code and European trade to understand the term unfairness in light of the legal use of the word in the EU countries hitherto.
