Intellectual property and the conflict of law
The European Commission, DG XV, has published an invitation to tender for a study in intellectual property and the conflict of laws, in particular the question of applicable law in the new digital context. The first objective of the study would be to identify material (national legislation, jurisprudence, guidelines) from the EEA, Japan and the USA, which would provide an indication of the legal regime(s) considered applicable in cases of transnational exploitation (including infringement) of protected subject matter on-line. In a second stage, the material should determine where there are divergences and conflicts which could disrupt the smooth functioning of the internal market and lead to distortions of competition, or other harmful phenomena. It should finally assess possible solutions and present conclusions in a final report.
