Case reports on EU’s environmental law accessible

This week Caselex starts rolling out national Supreme Court cases on the application of the European Union’s (EU) abundant base of environmental law, which is set to be more strongly enforced when the European Commission’s new environmental priorities enter into force.

Regulating the environment since 30 years: In the past 30 years the EU has adopted a substantial and diverse range of environmental measures aimed at improving the quality of the environment for European citizens in order to offer a high quality of life. Over 200 legal acts cover environmental issues, including water, air, nature, biodiversity, waste, and chemicals. Caselex ensures transparency and guidance: A substantial amount of court cases address EU’s legal framework. Caselex reports on such cases, allowing legal professionals and policy makers to monitor the application of EU’s environmental law next to providing guidance on its practical application. From the outset Caselex holds digests on more than 100 national decisions plus the relevant cases of the European Court of Justice. Moreover, new cases will derive from the EU’s improved enforcement measures set for 2009. Call for improved enforcement of EU’s environmental law: With demanding environmental challenges ahead, Mr Stavros Dimas, Member of the European Commission, responsible for environment, in his speech on 19 May 2008 to the European Parliament emphasised on environmental priorities: "For 2009, the key message is that timely implementation of existing legislation is vital and there is a need to 'encourage' Member States that are lagging behind in one area or another. The forthcoming Communication on the Implementation and Enforcement of EC environmental law will provide new tools and strategies to improve matters."
