Harmonization of copyright protection: Amended proposal
An amended proposal for a Council Directive harmonizing the term of protection of copyright and certain related rights (COM(92) 602) incorporates a number of alterations to the text of the earlier proposal (OJ No C 92 of 11.4.1992). The amendments are printed in parallel with the full text of the original. Inter alia, harmonization must cover not only the terms of protection as such, but also certain implementing arrangements such as the date from which each term is calculated. It is therefore necessary to harmonize the definition of authorship of cinematographic or audiovisual work. Certain articles of Council Directive 92/100/EEC of 19.11.1992 should be repealed in order to align the terms laid down in the present proposal. For the smooth functioning of the single market, the Directive must apply immediately it enters into force. It is proposed that the laws and administrative provisions necessary for Member State compliance with the Directive be brought into force by 1 July 1993.
