The European Commission has published its Directive of 13 October 1994 amending Directive 88/301/EEC and Directive 90/388/EEC in particular with regard to satellite communications. The Directive is adopted as a result of the 1990 Commission Green Paper, the 1991 Council Resolution, and the 1993 Parliament Resolution on satellite communications which set out the major changes in the regulatory environment necessary to exploit the potential of this means of communication. In particular, the Satellite Green Paper and Resolutions called for the harmonization and liberalization of the market for satellite earth stations, including the abolition of all exclusive or special rights in this area, subject to licensing procedures. The present Directive therefore amends Directive 88/301/EEC, which provides for the abolition of special or exclusive rights in the markets in telecommunications terminal equipment, by specifying the type of rights actually involved. Directive 90/388/EEC, referring to the markets for telecommunications services, is amended to include satellite services in its field of application.
