Objective
The project consists of a two-year legal and institutional assistance programme intended to advise the Kingdom of Morocco on environmental management. Morocco requires additional strengthening and adjustments to its legal system to prepare final versions of two draft laws, one a framework law on environmental protection and promotion and the other a law on coastal environmental protection and management. Morocco also needs to set up environmental institutions which are still lacking at national and local levels, and to improve the work of the existing institutions.
Experts will provide legal assistance to an interministerial working group made up of representatives from departments directly concerned.
For the draft framework law on environmental protection and promotion, the assistance will particularly contribute to (1) the achievement of a global perception of the environment stressing an integrated approach to its management, protection and promotion and (2) the setting up of an overall legislative framework of conservation of the environment, the contents of which will be further developed by regulations that govern particular sectors.
The draft law on the protection of the coast will enable:
- the development of legislation in conformity with international and Community law;
- assurance of better protection and of better management of the coastal environment.
Before setting up national and local structures of management of the environment, an audit of the situation will be carried out, on the ground, by a mixed team (engineers and lawyers, Morrocans and Europeans). Institutional assistance will facilitate the involvement of experts in the work of a subcommittee made up of representatives of the principal ministries concerned, of external state services, local and national representatives and environmental protection associations. This subcommittee will be instructed to propose, on the one hand, a new distribution of the competences between the state and the local authorities in the field of the environment, and, on the other hand, the creation of relevant external services in the field of the environment and of structures of coordination at local level. It will also have as its aim the creation of an environment inspectorate to propose, on the basis of an exhaustive inventory of the various categories of officials entitled to report the infringements of environmental regulations, the creation of this inspectorate and to develop, inter alia, the coordination procedures.
