European and Japanese semiconductor industry agree to prevent anti-dumping conflicts
The European Commission has recently approved an agreement entered into by the European Electronic Components Manufacturers Association (EECA) and the Electronic Industries Association of Japan (EIAJ). The agreement provides for the creation of a data collection and maintenance system for certain semiconductors in order to ensure the speedy resolution of anti-dumping procedures. The agreement covers Dynamic Random Access Memories (DRAMs) and Flash Erasable Programmable Read-Only Memories (Flash EPROMs) semiconductors. The Commission assessed the agreement with regard to EU competition rules and, in finding no conflict, gave its approval. This has been granted on the understanding that the company and product-specific data collected on costs of production home market prices and export prices for DRAMs and for Flash EPROMs will be kept strictly confidential. Only the European Commission or the Japanese anti-dumping authorities will have access to the data once an anti-dumping procedure is initiated. In this case the agreement provides that neither the associations nor their member companies will exchange prices or data among themselves nor discuss price development with the purpose of avoiding future anti-dumping proceedings.
