On 29 April 1991, the Council of the European Communities adopted a Directive (91/263/EEC) on the approximation of the laws of the Member States concerning telecommunications terminal equipment, including the mutual recognition of their conformity. Defining "terminal equipment" and stating its importance with regard to the internal market, the Directive sets out rules for Member States to ensure that such equipment is marketed or put into service only when in compliance with harmonized safety and technical requirements. Inter alia, equipment shall be assessed for conformity to the harmonized regulations by a notified body designated by the Member State and itself conforming to minimum criteria. After either European Communities type-examination or European Communities declaration of conformity, a CE conformity mark will be affixed to this equipment. Member States will not impede free circulation, marketing or use of compliant equipment and will introduce measures necessary to implement the Directive not later than 6 November 1992.
