Objective
L 'objectif du présent projet est de définir et de conceptualiser la question de la séparation des pouvoirs dans le cadre du système institutionnel de l'Union européenne. Plus précisément, il s'agit d'établir quelles sont les articulations entre les institutions politiques de l'Union et ses institutions juridictionnelles, puis de déterminer le sens et la portée de la théorie de la séparation des pouvoirs dans cette configuration institutionnelle. Le cadre méthodologique adopté sera celui du droit constitutionnel, et dans une moindre mesure du droit comparé. Le projet implique un travail préliminaire sur la théorie de la séparation des pouvoirs dans une perspective comparée, notamment dans les systèmes constitutionnels des Etats occidentaux avec une attention particulière portée aux systèmes fédéraux. Puis, il conviendra d'établir les frontières du partage des pouvoirs entre le politique et le juridictionnel. Ces frontières résultent des traités constitutifs, des pratiques institutionnelles et, surtout, de la jurisprudence de la Cour de justice, portant sur ses propres compétences ainsi que sur les limites du pouvoir discrétionnaire des institutions politiques. L'accent sera mis sur l'évolution récente de la position de la Cour à ce sujet, ce qui n' a pas fait l'objet de développements importants dans la doctrine. Cette analyse débouchera sur une tentative conceptualisation de l'objet ainsi défini.
