Objective
FoLC aims at analysing the forging of ‘legal confluences’ based on the drafting, implementation and present-day reverberation of the Civil Codes for French Indochina, more specifically those issued for the territories that make up today's Vietnam (1887-1940). More particularly, the project will investigate why, to what degree and how cultural and legal differences were bridged in order to achieve a sought-after confluence between the French civil law model and Annamite Confucian law and culture. How were cultural, social and legal differences identified, documented and evaluated by the colonizer? What were the main obstacles and resistances the codes’ drafters had to overcome to carry out a transition from imposed transplant to accepted borrowing? How were the ‘Indochinese’ Civil Codes perceived by the Annamite elite and population and how were they enforced by the indigenous and colonial courts? Did a potentially achieved confluence during the colonial period resonate until present day and is this the reason why the Vietnamese legislator still considered the French Civil Code in the 1990s as ‘golden rule’ for the drafting of its new Civil Code?
Using and making available unpublished, and largely unexplored archives, the project aims to reconsider current theories of legal transfers, breaking away from the traditional Eurocentric perspective. Reframing the epistemic foundations of legal pluralism, FoLC will open possibilities of rewriting the canons of comparative law and the narratives of legal histories of Empires. By revisiting the encounter between the French and Vietnamese Empires in a more symmetrical way and from a transcultural perspective, FoLC intends to develop an innovative ‘legal-cultural’ confluence paradigm to better understand questionings about present-day reverberations and/or rejections of colonial legal legacies.
