Developing a behaviourally informed Approach to the legal regulation of Market Behaviour and Institutions

The proposed research aims to develop the analysis of the legal regulation of market behaviour and institutions, including contracts, business associations, and competition law. Specifically, this work will examine the significance and implications of empirical psychological findings on human judgment and decision making for the legal analysis of the aforementioned areas. It will do so by applying robust psychological findings to novel legal issues.

Research foci will include:
a) a systematic mapping of main behavioural findings in relation to the law, with a special emphasis on criteria for and policy implications of distinguishing boundedly rational from hyper-rational behaviour;
b) an examination of variables promoting and hindering cooperation and rivalry as they relate to competition law, especially in the area of horizontal restraints of trade; and a study of the behavioural components of and solutions for the pervasive agency problem that arises in various legal domains; including agency, partnership, corporations and more; where the agent has control over the principal's resources and may abuse this power for his personal ends.

Supporting this research through the reintegration grant will provide the researcher with the necessary resources to promote this research agenda at the University of Haifa Faculty of Law, directly and fully promoting the goals of this action. It will also help position European research in the forefront of current legal scholarship.
