Electronic Arbitration Tribunal: an Alternative Dispute Resolution for SMEs

Obiettivo

E-Arbitration-T will provide a networked dispute resolution forum within the eCommerce community. It will analyse and define the technological requirements, the necessary infrastructure and the regulatory framework for establishing and co-ordinating an internationally-distributed Arbitration Tribunal using networked computers and intelligent multi-agent systems as their primary means of communication. The project will also deliver a validated agent architecture and concrete exploitation plans.

OBJECTIVES
The main objective is to provide a networked dispute resolution forum with the same style and ease of access as exists between business partners within the eCommerce community. It will develop and validate the regulatory structure and the dynamic and intelligent infrastructure needed to allow simple and efficient distributed processes in electronic out-of-court dispute settlement systems.

In particular: (i) to develop a deep analysis of arbitration processes in order to define the tasks that can have the highest degree of ubiquity and automatization; (ii) to guarantee a secure and reliable environment through which users may safely access the service through the Internet; (iii) to provide the legal framework for defining the activities, procedures, best practices and competence of the E-Arbitration. The E-Arbitration-T framework will be particularly targeted at the needs of SMEs.

DESCRIPTION OF WORK
The E-Arbitration-T Project will analyse, define, pilot and validate the technological requirements, the necessary infrastructure and the regulatory framework for establishing and co-ordinating a seamless Arbitration Tribunal using networked computers as their primary means of communication. To establish the international legal framework the project needs to analyse existing solutions. This will require the study of legal documents (at European and international level) and Treaties relevant to out-of-court dispute resolution mechanisms, particularly in the context of international commercial relations and electronic commerce. To implement its technological objectives, the project will define the initial framework for the E-Arbitration Tribunal using Multi-Agent communication protocols for maintaining the relationship, security and transparency between all parties to the process (Appointing Authority, Claimants, Respondents, and Arbitrators). It will also define the users' interactive interfaces and components for all stages of the process (asserting, documenting, arbitrating and resolving) and for all the parties involved in the arbitral procedures and the systems of storage for the standardised acts of the arbitration. To implement an intelligent arbitration processes as a Smart Organization the E-Arbitration-T Project will develop autonomous agents capable of reasoning based on experience and improving their arbitration behaviour incrementally. The project will also define a very large exploitation and dissemination strategy and will demonstrate worldwide the effectiveness of the E-Arbitration Tribunal Project in full scale deployment using modelling and simulation techniques and a demonstration software.
